White House backs Cheney’s disregard for executive order

White House spokeswoman Dana Perino said Cheney was not obligated to submit to oversight by an office that safeguards classified information. Cheney’s office has argued it does not have to comply because the vice president’s role as president of the Senate means his office is not an “entity within the executive branch.”

“This is a little bit of a non-issue,” Perino said at a briefing dominated by the issue. Cheney is not subject to the executive order, she said, “because the president gets to decide whether or not he should be treated separately, and he’s decided that he should.”

Democratic critics said Cheney is distorting the plain meaning of the executive order. “Vice President Cheney is expanding the administration’s policy on torture to include tortured logic,” said Senate Majority Whip Richard Durbin, D-Ill.

Rep. Rahm Emanuel, D-Ill., said “…if Cheney is not part of the executive branch, he should not receive its funds.”

WASHINGTON — The White House said Friday that, like Vice President Dick Cheney’s office, President Bush’s office is not allowing an independent federal watchdog to oversee its handling of classified national security information.

An executive order that Bush issued in March 2003 — amending an existing order — requires all government agencies that are part of the executive branch to submit to oversight. Although it doesn’t specifically say so, Bush’s order was not meant to apply to the vice president’s office or the president’s office, a White House spokesman said.

WASHINGTON — Dick Cheney, who has wielded extraordinary executive power as he transformed the image of the vice presidency, is asserting that his office is not actually part of the executive branch.

So, while we sleep and bicker about nonsense, we have elected dictators who are successfully dismantling the document that created The United States of America. Our Founding Fathers tried to protect us from what is happening RIGHT NOW! We are loosing this country at an alarming rate – the Democrats are ‘tapping the breaks’ on a disentigrating country because they don’t have the Majority available to ‘slam on the breaks’! This is a race against free-falling into a Fascist Dictatorship. The identity of ‘AMERICA’ is the sum total of its’ clueless, religion bickering, gay rights bickering, Paris Hilton bickering, racial bickering population. If we can save this country in time, we can return safely to the internal bickering we love.

    The constitution explicitly gives the president the authority of Commander-in-chief, congress has only the authority to appropriate funds for war, not oversight and micro-management. To the extent that the spy program is apart of the war effort is a matter of debate, but I’m frankly glad that the White House doesn’t disclose this to congress. There’s already been a fair amount of leaking from congress on this matter. Do we really need Dick Durbin giving away national security secrets to our enemies?

    Well you are correct on some of your statements about Congress. However, Congress does have the powers of oversight of the executive branch, especially regarding civil liberties which is the current case with Cheney.

    Congress, in addition to its lawmaking duties, has oversight authority over the Executive Branch.

    The Supreme Court made legitimate the oversight powers of Congress, subject to constitutional safeguards for civil liberties, on several occasions.

    In 1927, for instance, the High Court found that in investigating the administration of the Justice Department, Congress was considering a subject “on which legislation could be had or would be materially aided by the information which the investigation was calculated to elicit.”

    See: McGrain v. Daugherty, 273 U.S. 135, 177 (1927). See also Watkins v. United States, 354 U.S. 178, 187 (1957) and Barenblatt v. United States, 360 U.S. 109, 111 (1959).

    Oversight also derives from the many and varied express powers of the Congress in the Constitution. It is implied in the legislature’s authority, among other powers and duties, to appropriate funds, enact laws, raise and support armies, provide for a Navy, declare war, and impeach and remove from office the President, Vice President, and other civil officers.

    Congress could not reasonably or responsibly exercise these powers without knowing what the executive was doing; how programs were being administered, by whom, and at what cost; and whether officials were obeying the law and complying with legislative intent.

    Cheney acts as if he is above the law.

    Dick Cheney is the power behind the throne. Of course, he and Bush believe they are exempt from Presidential Executive Orders.

    Still, Presidential Executive Orders during the War on Terror can be used by the executive branch to further destroy the Constitution and our liberties.
